1. Introduction

Welcome to Joompa ("we," "our," or "us"). By accessing or using our website, mobile application, or any other services we offer (collectively, the "Services"), you agree to be bound by these Terms of Service.

Please read these Terms carefully. If you do not agree with these Terms, you may not access or use our Services.

2. Using Our Services

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years old.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

You agree not to use our Services for any purpose that is prohibited by these Terms. You are responsible for all of your activity in connection with the Services.

Prohibited activities include, but are not limited to:

• Posting illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content

• Posting spam or advertisements
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running our Services
• Taking any action that imposes an unreasonable or disproportionately large load on our infrastructure
• Uploading invalid data, viruses, worms, or other software agents through our Services
• Collecting or harvesting any personally identifiable information from our Services
• Using our Services for any commercial solicitation purposes without our prior written consent

5. Transactions Between Users

Joompa is a platform that allows users to list and find items and services. We are not a party to any transaction between users. As a result, we have no control over the quality, safety, legality or availability of the items or services advertised, the truth or accuracy of the listings, or the ability of users to complete a transaction.

We encourage you to take reasonable precautions when engaging in transactions with other users, such as meeting in public places, bringing a friend, and inspecting items before purchase.

You release us from any claims, demands, and damages arising out of disputes with other users or third parties in connection with your use of our Services.

6. Intellectual Property

Our Services and their original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Joompa and its licensors. Our Services are protected by copyright, trademark, and other laws of Malaysia and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Limitation of Liability

In no event shall Joompa, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use our Services; (ii) any conduct or content of any third party on our Services; (iii) any content obtained from our Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our Services.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
